Terms of Sale

These Terms of Sale ("ToS") apply to any subscription to the paid services of DigiSolut by a restaurant professional (the "Customer").
1. Purpose
These ToS set out the subscription, payment, renewal and termination terms of the SaaS services provided by DigiSolut: websites, booking system, loyalty programs, online ordering, AI and marketing add-ons.
2. Plans and pricing
Current plans are published on digisolut.com/pricing. Prices are in euros, before tax, and may be billed monthly or annually. Add-ons (e.g. Lucky Wheel, advanced AI assistants) are invoiced separately as indicated.
3. Order and evidence
Any order implies full acceptance of these ToS. Orders are confirmed by email. Electronic exchanges between the parties serve as evidence.
4. Payment
Payment is processed by credit card or direct debit via our secure payment provider. Invoices are issued at the start of each billing period. In case of payment failure, DigiSolut may suspend access after a reminder.
5. Term and renewal
Subscriptions are entered into for the term chosen at signup (monthly or annual) and renew automatically for equivalent periods unless terminated.
6. Termination
The Customer may terminate from the workspace or by email to billing@digisolut.com, at least 30 days before the annual renewal, or at any time before the end of the current month for monthly subscriptions. Amounts already paid are not refunded pro rata, unless required by law.
7. Right of withdrawal
As the Customer is a professional acting in the course of their business, the consumer right of withdrawal does not apply.
8. DigiSolut's obligations
- deliver the service in line with the subscribed plan;
- maintain continuity of service on a best-effort basis;
- protect data in accordance with the Privacy Policy;
- provide customer support during the hours published on digisolut.com.
9. Customer obligations
- use the service in good faith and in accordance with the Terms of Use;
- pay invoices on the due date;
- provide information needed for the service;
- secure the rights to the content they publish (photos, texts, menus).
10. Liability
DigiSolut's liability is limited, to the extent permitted by law, to the total amount paid by the Customer during the twelve months preceding the triggering event. Indirect losses (revenue, reputation, data losses attributable to the Customer) are excluded.
11. Force majeure
Neither party is liable for a failure caused by force majeure (natural disaster, power or telecom outages, acts of public authorities, etc.).
12. Governing law and disputes
These ToS are governed by French law. The parties will seek an amicable resolution before any legal action. Failing this, French courts shall have exclusive jurisdiction.
